Pfizer, the world’s largest drugmaker, has announced that it will pay $50 million to settle U. S. patent litigation against AstraZeneca over its over-the-counter anti-inflammatory drug Zetia (for use as an ear substitute). The company, which also sells other similar brands, agreed to pay $75 million to settle the litigation.
Zetia’s patent on Zetia has since expired, and it has yet to enter into a settlement agreement with the United States, and is likely to be the largest drugmaker in the world.
Pfizer has made no secret about its desire to make a profit in the near future. But a report by the New England Journal of a company called Warner-Lambert says the company plans to make Zetia in the next few years, with sales up to $5 billion.
The report also says Pfizer is preparing a new drug to treat a class of medicines called “non-steroidal anti-inflammatory drugs,” which include Zetia.
Pfizer is also preparing for lawsuits in federal court in New Jersey, where it has an intellectual property dispute. The firm has also been in contact with other generic drugmakers, but said it has not heard from any of them.
Pfizer has a patent on Zetia, which expires in June. It will be sold in Canada as a generic version of AstraZeneca’s blockbuster cholesterol drug Lipitor (atorvastatin).
But the company says it’s not planning to introduce Zetia until 2023, and says it is “still in discussions” with regulators about the patent’s fate.

In April, Pfizer said it had agreed to pay $75 million to settle U. patent litigation over the drug’s use as an ear substitute, and will pay $75 million to resolve a case brought by a plaintiff who claimed that Pfizer violated the Hatch-Waxman Act, which allows the FDA to approve drugs for uses the FDA has not approved.
AstraZeneca has been facing lawsuits by plaintiffs who claim the drug is used to treat a wide range of conditions, including heartburn, acid reflux, cancer and inflammation.
The drugmaker has a patent on Zetia that expires in March, and a generic version is expected to be sold in Canada in 2023. But Pfizer said it will not make any public statement until 2023.
The firm said that in addition to the settlement, it will pay a royalty to Pfizer on future sales.
